国际人权法主要文书的内容和精神都表明受教育权是一项基本人权而不附带任何义务,战后各国的国内法的修改也表现出接受这种精神的趋向。保障公民的受教育权要求国家承担起相应的义务。我国要顺应国际人权法发展的要求,在条件成熟时对宪法的相关条款进行修改,删除公民有受教育的义务的提法。
英文摘要:
The main documents regarding international law of human rights indicate that the right to receive education is the fundamental right without any subsidiary obligation. And the amendment of relevant domestic laws after the World War II also demonst rates such tendency. The guarantee of the right to receive education demands count ries to undertake corresponding obligations. China ought to comply with the development of international law of human rights, and delete the provision that declares the right to receive education is civil obligation in the current Constitution.
