现行法下的宅基地权利制度运行失灵，实践中于宅基地继承、内部转让、跨村配置、移民安置、市场化利用、经营性使用等情形，存在大量“法外”运行的宅基地利用样态。这些利用样态在主体、功能、用途上呈现出分化。宅基地法定租赁权的设想无法涵盖实践中丰富的宅基地利用需求，以体系化思维融合多种举措分类重构宅基地权利制度成为必要。以“三条底线”和“体系化分类设计”为指导思想，在总结各地实践探索经验和多方理论研究成果的基础上，以“扩权+转权+分权”为核心内容的宅基地权利制度重构方案，可以为实施乡村振兴战略背景下的深化改革和完善立法提供借鉴。
英文摘要：
The rights system on the rural house sites under the current law is not working. In practice, there are a large number of "extra-legal" use of the rural house sites in such cases as rural house sites inheritance, internal transfer, cross-village allocation, resettlement, market utilization, and operational use, which diverse in terms of their subject, function, and usage. Since the idea of legal leasehold rights of the rural house sites cannot cover the rich needs in practice, it is necessary to reconstruct the rights system on the rural house sites by systematically integrating multiple measures. Taking the "three bottom lines" and "systematic classification design" as the guiding ideology and basing on the summarization of practical experience and theoretical research results, this paper proposes a reconstruction scheme of rights system on the rural house sites that takes "extending rights+transferring rights+separating rights" as its core content, so as to provide reference for the further reformation and improvement of legislation against the background of implementing the rural revitalization strategy.
